1. Introduction

Welcome to BorrowMe ("we", "our", "us"). These Terms of Service ("Terms") govern your use of our website, mobile application, and services (collectively, the "Platform"). By accessing or using BorrowMe, you agree to be bound by these Terms. If you do not agree, please do not use our Platform.

BorrowMe is a peer-to-peer rental marketplace that enables users to lend and borrow items locally. We act as an intermediary platform and are not a party to any rental agreement between users.

2. Eligibility

  • You must be at least 18 years old to use BorrowMe.
  • You must be a resident of the United Kingdom.
  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the security of your account credentials.

3. User Accounts

You are responsible for all activity that occurs under your account. You must immediately notify us of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Listing Items (Lenders)

As a lender, you agree to:

  • Only list items that you legally own or have authority to lend.
  • Provide accurate descriptions, images, and pricing for your items.
  • Ensure items are in safe, working condition before lending.
  • Not list prohibited items including weapons, illegal substances, hazardous materials, or stolen goods.
  • Respond to booking requests in a timely manner.
  • Complete Stripe Connect onboarding to receive payments.

5. Borrowing Items (Borrowers)

As a borrower, you agree to:

  • Treat borrowed items with reasonable care.
  • Return items on time and in the same condition as received (fair wear and tear excepted).
  • Pay the agreed rental price and any applicable fees.
  • Compensate the lender for any damage, loss, or late return of items.
  • Not sub-lend items to third parties.

6. Payments & Fees

  • All payments are processed securely through Stripe.
  • BorrowMe charges a 15% platform fee on each transaction, deducted from the lender's payout.
  • Payments are held in escrow until the rental period begins.
  • Refunds are handled on a case-by-case basis. See our refund policy below.
  • Lenders must complete Stripe Connect onboarding to receive payouts.
  • All prices are displayed in GBP (£) and include applicable fees unless otherwise stated.

7. Refund Policy

  • Before rental period starts: Full refund if cancelled at least 24 hours before the start date.
  • Item not as described: Full refund if reported within 2 hours of collection.
  • Lender cancellation: Full refund to borrower.
  • During rental period: Partial refunds may be issued at our discretion.
  • Disputes should be raised through our support system.

8. Verification

BorrowMe offers identity verification to build trust between users. Verification can be completed via coupon codes, completing 5 successful bookings, or paying a £3 fee for Stripe Identity verification. Verification badges indicate that a user has completed our verification process but do not constitute a guarantee of trustworthiness.

9. Prohibited Conduct

You must not:

  • Use the Platform for any unlawful purpose.
  • Post false, misleading, or fraudulent listings.
  • Harass, threaten, or abuse other users.
  • Circumvent our payment system to avoid fees.
  • Create multiple accounts to manipulate reviews or ratings.
  • Scrape, crawl, or use automated means to access the Platform without permission.
  • Upload malicious content, viruses, or harmful code.

10. Limitation of Liability

BorrowMe is a platform that connects lenders and borrowers. We are not responsible for the condition, safety, legality, or suitability of any items listed. We are not liable for any loss, damage, injury, or disputes arising from transactions between users.

To the maximum extent permitted by law, BorrowMe's total liability to you for any claims arising from your use of the Platform shall not exceed the total fees you have paid to BorrowMe in the 12 months preceding the claim.

11. Intellectual Property

All content, branding, and technology on BorrowMe are owned by us or our licensors. By posting content (listings, reviews, images), you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content on our Platform.

12. Termination

We may suspend or terminate your account at any time if you breach these Terms. You may delete your account at any time through your account settings. Upon termination, any outstanding payment obligations remain in effect.

13. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or a notice on the Platform. Continued use of BorrowMe after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
